J&K: CAT orders Govt not to cancel the candidature/selection of the applicant for CCE, 2021
Jammu, July 01: In O.A./427/2023 titled KHIRED TANVEER Vs GENERAL ADMINISTRATIVE DEPARTMENT, a bench of Honble Member (J) Suresh Kumar Batra ordered as:-
Heard learned counsel for the applicant as well as learned AAG in respect of interim relief claimed by the applicant.
Learned counsel for the applicant submitted that the applicant has qualified for J&K Combined Competitive Examination, 2021 and JKPSC has recommended the name of the applicant for deployment for medical examination vide order dated 19.01.2023 , wherein the name of the applicant is figuring at Serial No. 137 in RBA category.
Persuant to the recommendation of JKPSC, respondent No. 1 has sought email id and contact number, details from the selected candidates within seven days of issuance of letter dated 24.02.2023 the name of the candidate is also figuring at Serial No. 131.
However, due to cancellation of RBA certificate of the applicant by the Tehsildar, Darhal, the respondent No. 1 has not issued appointment letter to the applicant.
Learned DAG submitted that investigation has been initiated in respect of the officials, who have cancelled the RBA certificate of the candidates.
In view of the above, the prima facie case of interim in favour of the applicant has been made out since, the applicant has qualified the J&K Combines Competitive Examination, 2021 held by JKPSC.
The respondents are directed not to cancel the candidature/selection of the applicant for CCE, 2021 till the disposal of O.A.
List the matter on 01.08.2023.
