Odisa Govt to Regularise Contractual Employees Appointed Under NHM After Proper Verification of Order & Documents
Odisha, 5 Dec, 2020: Minutes of the meetings of the high power committee meeting held on 16.11.2020 in the 2nd floor conference hall of apc to consider regularisation of contractual services of staff nurses, pharmacists, laboratory technicians, radiographers engaged under various schemes/societies as per the pip(nhm)/approval of govt.

Minutes of the Meeting:
The High Power Committee meeting was convened on 16.11.2020 at 11 A.M. under the Chairmanship of Additional Chief Secretary to Govt., Health & F.W. Department to consider the proposal received from the CDM & PHOs/ Superintendents MC & Hs relating to regularisation of contractual service of Staff Nurses, Pharmacists, Laboratory Technicians, Radiographers working under Schemes/Societies of the respective districts pursuant to Odisha Nursing Service (Method of Recruitment and Conditions of Service) Rules, 2019, Odisha Pharmacist Service (Methods of Recruitment and Conditions of Service) Rules, 2019, Odisha Laboratory Technician Service (Methods of Recruitment and Conditions of Service) Rules and Odisha Radiographer Service (Methods of Recruitment and Conditions of Service) Rules, 2019 read with Resolution No. 1066-GAD-SC- Rules -0009/2013/Gen. / dtd. 16th January, 2014 of GA & PG Department.
 
On dated 29.6.2020, the present proposals related to the districts namely Balangir/ Dhenkanal / Bhadrak/ Kalahandi/Deogarh/ Sundargarh / Koraput/ Cuttack/ Mayurbhanj/Sambalpur and MCHs namely VIMSAR, Burla & SCB MCH, Cuttack were discussed and finalised. But out of the Committee members present in the meeting held on 29.06.2020, the than FA cum-Additional Secretary Sri Subhransu Mohan Das got retired on 30.6.2020 and could not sign in the proceeding. Hence to ratify the decisions taken up in the said meeting, the proposals were discussed in the present meeting and finalised as below-
The Rules provide for induction & regularization of the contractual employees subject to fulfillment of eligibility criteria prescribed therein. 
The Deputy Secretary, I/ C, MS-III Branch initiating the discussion put forth the detail guidelines/ instruction followed during scrutiny of the information submitted by the concerned CDM & PHOs/ Superintendents in accordance with Rule 4 & 5 of the aforecited Rules framed in the year 2019 for the above four categories. It was submitted that the Screening Committee constituted vide order No 1390/dtd. 17.01.2020 of H & FW Department has verified all the documents and as well as the gradation list submitted by the CDM & PHOs/ Superintendents of MC & Hs. The detailed verification has been carried out with reference to the following documents.

In general the following decisions were taken-
1. Other than the designated categories such as Staff Nurse/Laboratory Technician/ Pharmacist/Radiographer for which regularisation has been provided under the Rules, no other category/ nomenclature of post shall be taken into consideration. 
2. All the contractual employees working in different fixed Health institutions/ facilities providing health care services & who have been duly engaged against approved positions of Government (GoI/GoO) ratified Programme Implementation Plan/ Action Plan of concerned Scheme/ Society, with the exclusions as mentioned at point No-1 and those who have been selected in a transparent manner having the requisite qualification & have completed 6 years of satisfactory contractual service from the date of joining in the Society/ Scheme, shall be declared as Regular Government employees against the regular sanctioned posts from the date of commencement of the new Rules. 
3. Out of the total eligible contractual employees under the schemes/societies, excluding the employees those have been declared as Govt. Regular employee as mentioned at para-2, all other contractual employees of a particular Cadre shall be declared as contractual Government employees against the regular sanctioned posts of the respective Cadre, from the date of commencement of the new Rules. The CDM & PHOs/ Superintendents of MC & Hs shall issue appointment letter accordingly. 
4. As & when the contractual Government employees as mentioned at point 3, complete 6 years from the date of joining in the respective scheme/ society, the CDM & PHO shall submit the proposal to the High Powered Committee through the concerned Directors for consideration of their regularisation. 
5. All the contractual employees under Societies/Schemes so inducted shall be adjusted against the existing vacancy in the respective category (UR/ SEBC/ST/ SC) of the districts folio ng the reservation principle.
6. Inter-se-seniority among the Contractual employees so inducted under Rule-4 shall be on the basis of their date of joining in the contractual service under the respective Society/Scheme. 
7. The present contractual employees under Societies /schemes who are so inducted under Rule-4 of the Cadre Rule, shall en-bloc be junior to the employees already existing, against the regular sanctioned post under General Health Care on the date of commencement of these Rules. 
8. Accordingly the CDM 85 PHO shall prepare a common gradation list immediately, including both the existing Government employees and the inducted employees following the provisions laid down in the respective Cadre Rules. The copy of such gradation list be submitted to the Department as well as to the concerned Directors for record within one month of receipt of proceeding of HPC. 
9. In view of regularisation of large no. of employees, there is every possibility of any omission or commission by the staff deployed for the scrutiny. Therefore the CDM 85 PHO/ Superintendent of MC & H, concerned shall re-verify the requisite documents and examine the same in the light of the principles adopted here in, prior to issue of the appointment letter to the staff to be inducted as Regular Government employees / Contractual Government Employee, by virtue of this proceeding. 
10.The CDM 85 PHO concerned shall also verify the up-to-date registration certificate of the candidate issued by the Odisha State Council of the respective Cadre. 
11.The discrepancy if any detected at later stage shall be immediately intimated to the Department for re-examination of the matter prior to issue of appointment order.
